For years the FCC has limited the maximum power output capability of an AM broadcast transmitter relative to the station's licensed operating power. For example, a 1 kW AM station could not use a transmitter rated for 5 kW output power, etc.
Sounds like the FCC has decided that doing so is no longer an issue with them.
