The law currently says that “any officer who qualifies for federal public office must resign from the office he or she presently holds if the terms, or any part thereof, run concurrently with each other.”
Some have interpreted that law to say that a Florida candidate running for federal office wouldn’t have to resign from their current elected position as long as they’re not also trying to be reelected to that position.

DeSantis can't run for President
DeSantis can't run for President
This has been quite quiet. Florida law doesn't allow a standing Governor run for another office without resigning. Of course being a swamp state, they'll just change the law for him.

Read the first paragraph you quoted. Qualified means you won an election. Why else would it be talking about not having concurrent terms?
Re: DeSantis can't run for President
Wrong. Qualified means you're on the ballot, but I think it means you can't run for two offices at once, which makes sense. Marco Rubio wasn't planning on running for Senate in 2016 until after he didn't win the nomination for president. He could not have concurrently ran for both offices. Since DeSantis ran and won in a landslide in 2022, there is nothing that prohibits him from running in 2024 and staying Florida's governor.Round Six wrote: ↑Wed Apr 26, 2023 10:11 pmC'mon.TC Talks wrote: ↑Wed Apr 26, 2023 9:06 pmThis has been quite quiet. Re: DeSantis can't run for President
Well legal scholars in Florida disagree with your assessment Matt, They are working to try to change the law. This is why we haven't heard him say boo about running for president.

Re: DeSantis can't run for President
Wrong as usual:
https://www.politico.com/news/2023/04/2 ... %20nominee.There have been dueling legal opinions about whether Florida’s existing “resign-to-run” law would apply to someone running for president or vice president. But GOP legislators have opted to remove any doubts with this legislative proposal.
“If there is ambiguity, and it’s been something that’s been talked about — especially ad nauseam since November if not longer — then let’s do it, let’s clarify it,” said Republican state Sen. Danny Burgess, the chair of the Senate Ethics and Elections Committee. “That way, should we be fortunate enough to have a president or vice president from Florida one day, we’ve cleared that air.”

Re: DeSantis can't run for President
I’m gonna interpret this to mean that if he WINS he must resign. He can run all he wants and still be Governor. That’s what it says.
Re: DeSantis can't run for President
I'm to the point where I almost don't care who is president anymore but I don't like that guy at all. People can bash Biden about stuff but at least it's not some stupid clown show everyday anymore, with Trump as the carnival barker. With Desantis, I just think he's nothing but a narcissist and bully.
Re: DeSantis can't run for President
Ron DeSantis could run for president without resigning his post as governor of Florida, according to an election bill amendment filed Tuesday by a Republican state senator.
The amendment to the elections bill, SB7050, would clarify qualification requirements for political offices and exempt “Persons seeking the office of President or Vice President of the United States” from state rules that require political office holders to resign their current position in order to qualify as a candidate for another office.
The strike-all amendment was filed Tuesday afternoon by state Senator Travis Hutson, a Republican from northeast Florida, whom DeSantis endorsed last year

Re: DeSantis can't run for President
There's no need to speculate on what "qualified" means or when the timing of such a resignation must take place as you need look no further than the ENTIRE law in question. While TC Talks provided an out-of-context snippet, hell may have frozen over as I do believe that his interpretation is correct and that everybody else's is wrong.

So there you have it. If you intend to seek another office, including a federal office, you must resign 10 days prior to qualifying to seek that office. That's not ambiguous as the Florida Republican legislators claim. If there's any ambiguity, it would be in exactly what "qualifies" means in regards to specifically running for President as the only qualifications are that you are natural born, at least 35 years old, have been living in the US for at least 14 years, and haven't been barred by Congress from holding office. So Arguably, DeSantis "qualified" for the office of President the day he turned 35. And I disagree with the notion that you must be on the ballot to "qualify" as you can run as a write-in candidate without appearing on the ballot. Nevertheless, qualification is only half of the story as the law also uses the phrase "intends to seek." As such, because DeSantis qualifies to run for President (which is indeed a federal office), I believe the law is quite clear that DeSantis would have to resign as governor at least 10 days before stating an intention to run.(c) The written resignation must be submitted at least 10 days prior to the first day of qualifying for the office he or she intends to seek.

Re: DeSantis can't run for President
How do you enforce an intention?
Ask not what your country can do FOR you; ask what they are about to do TO YOU!!
Re: DeSantis can't run for President
That's also in the law. Answer: Resignation is automatic. Basically, if DeSantis were to announce his intention of running for President, his resignation as governor would be automatic and immediate.
(f)1. The failure of an officer who qualifies for federal public office to submit a resignation pursuant to this subsection constitutes an automatic irrevocable resignation, effective immediately, from the office he or she presently holds.

Why anyone wants that fat fucking meatball to "make the USA Floriduh" I'll never understand. The shit he pulls works for backwoods rednecks in that state, but not (mostly) the rest of the country.

Running for president is pretty much a full time job.
You probably should have to quit your other job to run.
