What would happen if the President pardoned Trump from state crimes?
What would happen if the President pardoned Trump from state crimes?
Most legal scholars agree that Presidential pardon power does not extend to state crimes. Mark Levin disagrees. He argues that the Supremacy clause along with DOJ precedent would allow such a pardon. While I find Levin's argument weak and speculative at best, this does beg the question - what happens if Trump wins the Presidency and he decides to announce that he is pardoning himself from both federal and state crimes? Then what? How do various law enforcement agencies react? How about the Secret Service? If he's already sitting in a jail cell, would the guards let him out? How would that all play out?

What would happen? Talking heads shouting on TV, backbiting on the buzz board, nipping and arguing...the usual. That would be all. No.action.

Desperation from Mr. Levin aside… the idea that it cannot happen comes from somewhere… something happened in a court decision and established a precedent or something especially considering it’s not explicitly laid out that way.bmw wrote: ↑Thu Aug 17, 2023 5:04 pmMost legal scholars agree that Presidential pardon power does not extend to state crimes. It would end up in front of the Supreme Court.

Apparently, Mark Levin believes in federal supremacy over states rights. How many people are going to abandon principle for that orange POS?
Voting for Trump is dumber than playing Russian Roulette with fully loaded chambers.
Re: What would happen if the President pardoned Trump from state crimes?
This is the DOJ FAQ blurb on this… the constitution is very specific about this… the crimes must be against the United States:
So again Levin is desperate. The state of Georgia wouldn’t play ball and getting a pardon out of them is like pulling teeth.Does the president have authority to grant clemency for a state conviction?
No. The President’s clemency power is conferred by Article II, Section 2, Clause 1 of the Constitution of the United States, which provides: “The President . . . shall have Power to grant Reprieves and Pardons for Offenses against the United States, except in Cases of Impeachment.” Thus, the President’s authority to grant clemency is limited to federal offenses and offenses prosecuted by the United States Attorney for the District of Columbia in the name of the United States in the D.C. Superior Court. An offense that violates a state law is not an offense against the United States. A person who wishes to seek a pardon or a commutation of sentence for a state offense should contact the authorities of the state in which the conviction occurred. Such state authorities are typically the Governor or a state board of pardons and/or paroles, if the state government has created such a board.

I imagine he would be in protective custody kept away from gen pop and have his secret service team guarding him along with jail or prison guards. As for letting him out? Not until it has gone through the court system with the Supreme Court having the final say.

Yea, prisoners typically don't like creeps who brag about sexually assaulting women, who talk about how they would sexually abuse their daughter, and have possible connections to a child sex trafficker.
