Their length of service is not in the constitution. The constitution actually says next to nothing about the court. The Judicial Act sets that up. Number of justices, terms etc.

Ah, the keyboard constitutional scholar knows. :lol :lol :lol
It’s a couple of sentences.. Congress was left to determine the rest through the judicial act.

A President can declare "martial law" and all things will be on hold. That is "constitutional" also.
Determining the term length or the size of the court is done through the Judicial Act.

So says YOU.
That’s called a fact. I didn’t make it up... I’m just reporting it.

Form uscourts.gov, for what it's worth

"Article III, Section 1 of the Constitution establishes the Supreme Court of the United States. Currently, there are nine Justices on the Court. Before taking office, each Justice must be appointed by the President and confirmed by the Senate. Justices hold office during good behavior, typically, for life."

You all are kidding, right? Article 3 of the US Constitution (link below) establish a supreme (NOT capitalized) Court as “Congress may from time to time ordain and establish”. No number of justices, length of service, nothing more than the Senate will “advise and consent” on the President’s appointment of “judges to the supreme Court”. Please feel free to read the Constitution before slandering something like a political party.

And yes, the President can nominate someone to the Supreme Court up to noon on January 20th of the year after the election. The hypocrisy comes from changing the story to fit the situation, something that both parties have done in this situation. The swamp is getting deeper... This is only solved when politics moves out of the back room of the two party system and becomes open and transparent and available for anyone to participate.

Ding!

I disagree with some of RBG's decisions but who could argue that she failed the good behavior standard and could be removed?

If Democrats are trying to argue that a specific age or time period automatically makes bad behavior, then no senior should ever vote for them again and they need implement time limits on themselves.

How so? They want time limits for USC Justices. The constitution says they can remain on the court until there is bad behavior.

They only way the make is work is "being old = bad behavior".

I’m warming up to the idea of a 189 member court...

All 189 circuit court judges are made justices under a new judicial act. 9 are chosen at random from the pool to hear each case. They still sit on the circuit when not doing SCOTUS duties thus eliminating the partisan bent of the court to a degree.

So a lottery ball group of justices on each case won’t work for you?

Ii find it interesting those calling for the term limits are career politicians. It is they who should be term limited.
